General Terms

The purpose of these Particular Conditions of On-line Sale is to define the arrangements for sales between INTERNACIONAL DE PELUCAS CABELLO R., S.L. (hereinafter, CABELLO R or “the Company”) and the user or person placing the order.

Any order placed on www.cabellor.com implicitly entails as an essential, determining and indispensable condition, the full and unreserved acceptance by the Customer of the Particular Conditions of On-line Sale of CABELLO R in effect on the day on which the relevant order is placed. The Customer further acknowledges that the acceptance of these Particular Conditions implies the application thereof to the order to which they refer.

The fact that CABELLO R does not take recourse at a given point in time to these Particular Conditions may not be interpreted as nor be deemed equivalent to a waiver thereof, past or future.

In any event, the User states that s/he is of legal age, has full capacity to act, is able to read and understands perfectly all of the clauses that comprise these Particular Conditions. Minors may not use the Portal nor make online purchases without the prior consent of their parents or legal guardians.

All documents and contracts generated in the online sales process will be issued solely in the Spanish (Castilian) language.

CABELLO R reserves the right to modify these Particular Conditions of On-line Sale and the contents of its website www.pelucascabellor.com

 

Orders

The user has the option to place orders online. Making a purchase on CABELLO R’s website is very simple: one only has to select an item, add it to the basket by clicking on the shopping cart icon and going through the order process, using whichever means of payment one prefers.

An order can only be registered on the website if the user has first provided ID information by filling out the relevant form or by means of a double-key system (user name + password) which has been assigned to the user if s/he has registered previously. The correct entry of your data will allow the products to reach their destination in a satisfactory manner.

The moment the customer clicks on the option Definitive Order Confirmation within the online purchase process or sends a Definitive Order Confirmation email, the customer is deemed to have given their consent for the validity and enforceability of the sale/purchase agreement which is then binding on both parties.

The customer may track the order in the relevant section of the web page by entering the details of their email address and Order ID which was supplied when the order was confirmed.

CABELLO R undertakes to complete all orders received via the website within the limits of available inventory. If the product is not available, CABELLO R will inform the customer accordingly at the earliest opportunity.

CABELLO R carries out the sale and distribution of the products offered for sale on this web page from its company and sales headquarters, and hence all sales transactions are deemed to have been made at the company’s domicile, which is No. 36 calle Magdalena, ground floor. CP 28012, Madrid (Spain).

 

Product Sheets

The offers made by CABELLO R are valid within the limits of the stocks available. CABELLO R reserves the right to modify the range of its products in the event of difficulties caused by its suppliers.

The photographs, graphics and descriptions of the products offered for sale are for indicative purposes only and are not binding in any way on the vendor CABELLO R. Minor variations may occur in the specifications and content of the packet, the colours or design, caused by changes which manufacturers continually make to their products, variations which shall not entitle the purchaser to rescind this contract.It is expressly stated that the COLOUR of the products displayed in the virtual store may differ from the actual colour of the product. Every screen displays colours differently and hence the photos shown on this website can only serve as an approximate reference and NEVER as a guarantee of the hair’s real colour.

 

Price

All prices stated on the web page are expressed in Euros, inclusive of VAT at the rate legally applicable at the time the order is confirmed and exclusive of delivery costs and payment costs where applicable.

Purchases made by individual persons or legal entities incorporated in Spain (Peninsular Spain or the Balearic Islands) will be subject to VAT. Purchases made by individual persons domiciled in other member states of the European Union that are not acting as businesses shall also be subject to VAT. Purchases made by individual persons or legal entities domiciled in other Member States of the European Union that operate as businesses shall be exempt from the said tax provided they supply their intra-community VAT number in advance (reverse charge). Purchases made by individuals or legal entities in non-member States of the European Union, or in the Canary Islands, Ceuta or Melilla shall be exempt from VAT (exports).

When a sale is made with no VAT, the customer is responsible for paying the tax (as an importer or due to reverse charge), as the customer will be expressly informed when the order is fulfilled.

If the customer is domiciled in the Canary Islands, Ceuta, Melilla or in any other country that is not a member state of the European Union, he/she/it is likewise responsible for any import or customs duties payable in the destination country, over which CABELLO R has not control and for which CABELLO R does not assume any responsibility whatsoever under any circumstances. The recipient or purchaser shall bear the cost of such payment at all times. Before making a purchase we recommend that you check with your customs authority to obtain more detailed information in this regard.

CABELLO R reserves the right to update or modify its prices at any time, but undertakes to apply the prices currently published at the time the order is confirmed.

CABELLO R reserves the right to maintain prices other than those on its website in its physical retail outlet located at 26, calle Magdalena, 28012 de Madrid (Spain) in view of existing offers, different running costs, etc.

 

Place and times of delivery. Risk of loss or damage to goods.

The products will be delivered to the address specified by you during the online purchase process via the courier company selected by CABELLO R.It will not be possible to change the delivery address once the purchase process has been confirmed, unless such change is expressly accepted by CABELLO R and the customer expressly accepts to bear the extra delivery expenses that may apply and makes the relevant payment.

If when placing an order, the customer does not provide the complete address or it is incomplete, CABELLO R accepts no responsibility for any delays that may occur in delivery.

Important: Exact delivery times may not be selected. These will not be observed even if they are stated in the conditions of the order.

An order is deemed to have been delivered at the moment that the courier hands over the package or packages to the customer and the customer signs the receipt of delivery. It is the customer’s responsibility to check the condition of the goods upon receipt and to state any anomalies in the delivery note upon receiving the delivery. If the package does not appear to be in good condition please reject the delivery.

The calculation of deadlines shall be interrupted with no right on the part of the customer to any indemnity or compensation, if circumstances arise that are beyond the Company’s control and which delay delivery, either by natural causes (earthquakes, floods, fires …), or for social or political reasons (strikes, armed conflicts, border closures, commercial embargoes …). In such cases, the calculation of the delivery deadlines shall resume once the said circumstances have been overcome, have disappeared or ceased.

In the event that the product has not been delivered within the said period, before the purchase can be cancelled for said reason, you must call upon this Company to make delivery within an additional reasonable time frame that is appropriate to the circumstances (the additional period, in principle, will be half of the period initially set, and shall run from the first business day following that on which the Company receives such notice). If the delivery is not completed within said additional period, you will have the right to cancel the purchase, in which case you will be refunded all amounts paid by you forthwith.

The undertaking given by CABELLO R in respect of the sale and delivery of the goods offered for sale is subject to the stock of the product advertised and the availability thereof until the stock runs out, and hence CABELLO R in its commitment of quality and customer service shall at all times endeavour to ensure that all products advertised are available. Notwithstanding the foregoing:

(i) If in the purchase process, the customer is informed that any of the selected products is out of stock, CABELLO R contact the customer as soon as possible to inform him/her of this fact, and to inform him/her of the additional delivery period in which it will be able to complete the purchase requested (whenever possible from stock held at the factory from which it is sourced) or the possibility of acquiring other similar alternatives. In this case, if the client nonetheless decides to definitively confirm the purchase process, a further period of 10 calendar days shall be added to the delivery times indicated above, so that this Company can acquire and receive from the factory the stock of the product which will enable it to fulfil the order.

(ii) If in the purchase process the customer is told that the product selected is in stock, but subsequently exceptional circumstances occur in which there are multiple orders online that coincide or others that cause those the stocks of the product to be exhausted, CABELLO R will contact the customer at the earliest opportunity and may choose between maintaining the order, extending the deadline to 10 calendar days (necessary for the Company to acquire and receive stock from the factory of the product with which to fulfil the order), or cancel the order and the contract, reimbursing the customer for all sums paid in respect of the cancelled order.

Any risk of loss or deterioration of the goods will be borne by this Company until the product you have acquired has been delivered to you and will borne by you once you have received it and have acquired actual possession thereof.

 

Delivery costs

The customer will be informed as to the exact amount payable for delivery expenses before completing the online purchase process by the definitive purchase confirmation.

 The delivery costs include handling and packaging as well as postage. There is a fixed price for handling but delivery costs may vary depending on the total weight of the package. We would advise you to group together all of your items in a single order. We are unable to combine two different orders and delivery costs apply to each order individually. We shall make every effort to protect all fragile items.

The boxes we use are secure and your items will be well protected.

All products we sell are covered by the legal guarantee in accordance with the goods, in compliance with the Amended Text of the General Law on Consumer and User Protection.

The hair is covered by a 6-month warranty from the date of purchase. 

This guarantee excludes ageing of the hair, normal wear and tear due to use, any alteration of the product or alteration of the colour, and any defects in the product due to incorrect or inappropriate maintenance. Under no circumstances will CABELLO R accept any liability for the positioning of extensions.

 

Billing

CABELLO R will issue an invoice which it will send and deliver to you free of charge together with the order at the customer’s address or email address specified thereby.

CABELLO R warns you that you may not modify sales invoices as a later date in accordance with applicable law.

The invoice will be issued in the name of the individual person or legal entity that placed the order and so the customer must ensure that the order is placed in the correct name. No subsequent changes will be permitted to the name to which the invoice is issued.

Right to withdraw from the purchase

You have the right to withdraw from an online purchase with no obligation to explain or prove any reason whatever, within 14 calendar days to run from the day after the one on which it is delivered to you, provided you return the product in optimal condition and without any deterioration whatsoever.

The right to cancel the purchase does not include the purchase of wigs or hairpieces that have been prepared to the consumer’s individual specifications and have been clearly sold on a customized basis.

To exercise your cooling-off right, you must contact us either via the Contact form,or by sending an email to info@cabellor.com and, having received acknowledgement of receipt from us, returning the product to us at the Company’s address shown on the web page, within the afore-mentioned fourteen calendar-day period.

The product must be returned with its original labels, in the same packaging and box in which it was delivered to you, and with no manipulation whatsoever other than that which is strictly necessary to inspect its characteristics and for the customer to try it on. If the product has been handled in any other say (e.g. cut, washed, dyed, secured with adhesive or with signs of having been used) or is returned in a deteriorated state (torn, broken, soiled, etc.), the customer shall be responsible for its decrease in value and must compensate this Company accordingly, hence the customer may exercise the right to withdraw from the purchase but shall not be entitled to the full refund of the purchase price.

Any risk of loss or deterioration of the goods is borne by you until the returned product has actually been delivered to this Company.

The exercise of the right to withdraw from the purchase entails the obligation on your part to bear the full cost of returning the item to this Company. Hence, we will not accept any returned products on a cash or collect on delivery basis.

The Company will refund you for the total amount that you paid for the purchase (including delivery costs) within the 14 calendar days after the day on which the Company received the duly completed and signed withdrawal form and the returned product. In the event that the Company receives the withdrawal form but not the returned product, it shall suspend the refund until it has received the returned product or until you have submitted proof that you did return it. The refund shall be made following the same form of payment that you selected to pay for the goods, unless you choose to pay cash on delivery, in which case we will make a bank transfer to the bank account specified by you.

 

Warranty

After-sales Service Claims and Complaints.

If you wish to lodge a complaint in relation to any products you have acquired, you may do so by contacting this Company by post at the address displayed on this web page, by fax to the number stated on this web page or via the “Contact Us” section on this web page, detailing in all such cases, in addition to your identity information, the features of the product referred to in your complaint (model or catalogue reference, date of purchase, invoice number…), the reason for your complaint, and the manner in which you would like the Company to contact you (by telephone, email, normal post…).

The Company will immediately initiate a complaint procedure and will send you a password and complaint number with confirmation thereof. The Company will process and resolve the complaint or claim in the shortest possible time depending on the circumstances of each case but in any event no later than one month from the filing thereof.

 

Relevant Law. Forum.

In the case of purchases made by individual persons or legal entities acting as businesses or professionals: (i) such purchases shall be deemed to have made in Madrid, the capital city of Spain; (ii) they shall be governed by Spanish law throughout the national territory, and (iii) the parties shall waive recourse to any other forum and expressly submit to the jurisdiction of the Courts and Tribunals of Madrid in respect of any issue that may arise between the parties regarding the on-line purchase of products.

In the case of purchases made by individual persons or legal entities acting as consumers and users in a context other than a business or commercial activity and if they are domiciled in Spain: (i) such purchases shall be deemed to have been made in Madrid, the capital city of Spain; (ii) they shall be governed by Spanish law on the protection of consumers and users’ rights (Amended Text enacted by Royal Legislative Decree 1/2007); (iii) the parties shall waive recourse to any other forum and expressly submit to the jurisdiction of the Courts and Tribunals of Madrid in respect of any issue that may arise between the parties regarding the on-line purchase of products.

In the case of purchases made by individual persons or legal entities acting as consumers and users in a context other than a business or commercial activity and if they are NOT domiciled in Spain: (i) the purchases are deemed to have been made in Madrid; (ii) the applicable law shall be determined by the provisions of the Regulation EC 593/2008 dated 17 June, 2008 on the Applicable Law to Contractual Obligations (Rome I), and by such other disposition of EU Law that apply thereto (if the substance of the foreign law cannot be determined, the relevant Spanish law shall apply on a supplementary basis, that is to say, the Spanish law on the protection of consumers and users’ rights (the Amended Text enacted by Royal Legislative Decree 1/2007); and (iii) the parties shall waive recourse to any other forum and expressly submit to the jurisdiction of the Courts and Tribunals of Madrid in respect of any issue that may arise between the parties regarding the on-line purchase of products.
